
Oklahoma Auto Insurance Tort
System
Oklahoma has a tort system. Oklahoma state law
requires minimum auto coverage 25/50/25. Coverage is often sold with per person and total per loss maximum amount.
For example, 100/300/50 coverage means that you have coverage of $100,000 bodily injury liability insurance per
person, $300,000 total bodily injury liability insurance per accident, and $50,000 property damage liability per
accident. Proof of financial responsibility is required to respond to damages for liability arising out of the
ownership, maintenance or use of a vehicle of a type subject to registration under the laws of
Oklahoma.
Oklahoma car insurance law requires insurnace carriers issuing an owner’s
policy to supply a security verification form on a form approved by the Insurance Commissioner. The vehicle owner’s
insurance company or an individual’s non-owner insurance policy will provide the proper security verification
form.This statute specifies the minimum information that must be included. You must provide documentary proof
of Financial Responsibility in the following circumstances:
* At the request of a law
enforcement officer at the time of an accident or traffic stop;
* When registering a vehicle or renewing registration;
and
* When obtaining a drivers license.
To ensure drivers continue to meet the Financial
Responsibility requirements, Oklahoma requires insurance companies to notify the Department of Public Safety if the
person’s insurance is canceled within 180 days from the beginning date of a new policy. The Department of Public
Safety will then contact the person or the owner of the canceled policy for proof of insurance at your address on
file giving thirty (30) days to contact the Department of Public Safety and verify that you have valid insurance
coverage.
Penalty for failure to comply with Oklahoma’s Financial
Responsibility requirements:
Failure to maintain proper insurance could lead
to the suspension of your license and vehicle registration. You may face a fine of up to $350, thirty (30) days in
jail, or both.
In addition, you will face license suspension and
suspension of your vehicle registration if you are convicted of failure to comply with the minimum Compulsory
Insurance Law or if you fail to produce proof of insurance to a law enforcement officer or Public Safety
Representative upon request.
